By Poseidon, that's a very good point.J. Van Leeuwen in his commentary ad loc. points out that Hermes swears by the gods in Aristophanes, Wealth 1147 (πρὸς θεῶν), and that Jupiter sacrifices to himself in Plautus, Amphitruo 983 (mihi quom sacruficem).
νὴ τὸν Ποσειδῶ ταῦτά γέ τοι καλῶς λέγεις.
